Terms of service agreement

These Terms of Service govern your use of the Fragstats software (“Software”) and all related services provided through www.fragstats.org (“Website”). By installing, accessing, or using the Software, you agree to be bound by these Terms. If you do not agree, do not use the Software or the Website.

1. License and Permitted Use

Use of the Software is permitted only in accordance with the End User License posted at www.fragstats.org. All rights not expressly granted are reserved. The Software is licensed, not sold.

2. License Distribution

You may not share, transfer, sell, sublicense, or otherwise distribute your license or license file to any unauthorized person. Any unauthorized distribution is grounds for immediate termination of your license.

3. Abuse Prevention and Minimal Tracking

To prevent misuse of the Software, we perform minimal tracking, which may include recording the last time you authenticated or accessed your license. We may withdraw licenses, suspend access, or ban users who engage in abuse, misuse, or violations of this Agreement. Tracking is limited to what is necessary for security and license protection.

4. User Accounts

User accounts exist solely to:
  • Provide access to valid licenses you have been granted or purchased
  • Allow participation in the Fragstats forum
User accounts do not represent endorsements, affiliations, or verification of any user.

5. Forum Use

The Fragstats forum is provided exclusively for discussion related to Fragstats. Posts unrelated to Fragstats may be removed. Spamming, harassment, or abuse may result in temporary or permanent bans at our discretion.

6. Cookies and Website Data

The Website uses minimal session cookies only to maintain account access and functionality. These cookies are not used for tracking, profiling, or advertising.

7. Data Collection

We do not sell, share, or transfer user data to third parties, except as required to provide essential services (such as payment processing). We do not collect unnecessary personal information.

8. Payments via Paddle

If you make a payment or are redirected to paddle.com, your data will be handled according to Paddle’s own data collection and privacy policies. We are not responsible for Paddle’s practices.

9. Account Deletion

A user account is required to:
  • - Access your valid licenses
  • - Use the forum
  • - Pay for licenses
If you request deletion of your account by following the directions from your page, your license file will be permanently removed. For continued use of the software keep your copy of the license in a safe location. You will lose access to your licenses it until you create a new account and purchase a new license.

10. Disclaimer of Warranties

The Software and Website are provided “as is” without warranties of any kind, express or implied. We do not guarantee accuracy, reliability, availability, or fitness for any particular purpose. You assume all risks associated with using the Software.

11. Limitation of Liability

To the fullest extent permitted by law, the creator(s) of the Software and operators of the Website shall not be liable for any damages, losses, or claims arising from your use or inability to use the Software, Website, or forum. Your sole remedy is to discontinue use of the Software.

12. Termination

We may suspend or terminate your license or account at any time for violations of this Agreement or for abuse of the Software or Website. Upon termination, all rights granted to you under the Fragtats license and these Terms of service will immediately cease.

13. Changes to This Agreement

We may update or modify this Agreement at any time. Continued use of the Software after changes are posted constitutes acceptance of the updated Agreement.
